You have the right to inspect and obtain a copy of your health records maintained by Kind MD. You must submit your request in writing to our Privacy Officer. We will provide you with a copy of your records within 30 days. We may charge a reasonable fee for copying and mailing your records. In limited circumstances, we may deny access to your records, and we will provide you with an explanation if we do so.
You have the right to request an amendment to your health records if you believe information is inaccurate or incomplete. Your request must be submitted in writing and include the specific information you wish to amend and the reason for the amendment. We will respond within 60 days. If we deny your request, we will provide you with a written explanation. You may request that your amendment be included with your health records even if we deny the amendment.
You have the right to receive an accounting of disclosures of your health information. This accounting will include information about the date of the disclosure, the name and address of the person or organization to whom the information was disclosed, and the purpose of the disclosure. Accountings are available for disclosures made within the prior three years. You may request one accounting per calendar year at no cost. Additional accountings may result in a reasonable fee. We will provide the accounting within 30 days of your request.
You have the right to request that we restrict our use and disclosure of your health information. While we will consider your request, we are not required to agree to all restrictions. Requests must be submitted in writing to our Privacy Officer. If we agree to your restriction, we will honor it unless the information is needed for emergency treatment. Please note that even if you request a restriction, we may still use and disclose your information as required by law.
You have the right to request that we communicate with you about your health information by specific means or at specific locations. For example, you may request that we contact you only by email or at a specific phone number. We will accommodate reasonable requests. You have the right to be notified of any unauthorized access to or disclosure of your unsecured health information. If Kind MD experiences a breach of your health information, we will notify you without unreasonable delay and in no case later than 60 days after discovery of the breach.
Kind MD reserves the right to change this Notice of Privacy Practices at any time. We may make changes as required by law or at our discretion. If we make material changes to this notice, we will notify you of the changes and provide you with a copy of the revised notice. Changes will be effective on the date specified in the revised notice. Your continued use of Kind MD services after any changes constitute your acceptance of the revised notice. However, we will not use or disclose your health information in a way that is materially less protective of your privacy without your written consent.
