This Notice

Kind MD, a telehealth service operated by JayC Inc., is required by law to protect the privacy of your health information. This Notice of Privacy Practices describes how we may use and disclose your Protected Health Information (PHI) and outlines the rights you have regarding your medical records and personal health data.

This notice applies to all patients of Kind MD, including those who receive services through our website, mobile application, telehealth platform, and related services. Please read this notice carefully. If you have questions about anything in this notice, please contact our Privacy Officer.

Our Responsibilities

Under the Health Insurance Portability and Accountability Act (HIPAA) and related privacy regulations, Kind MD is required to:

Maintain the privacy and security of your Protected Health Information
Provide you with this Notice of Privacy Practices, which explains our privacy obligations and your rights
Follow the terms of the version of this notice that is currently in effect
Notify you if there is an unauthorized access to or disclosure of your unsecured health information
Comply with all applicable laws protecting your health information, including state and federal privacy laws that may be more stringent than HIPAA

How We May Use and Disclose Your Protected Health Information

We use and disclose your PHI for the following purposes:

Treatment

We use your health information to provide medical care and services to you. This includes:

Evaluating your medical history and symptoms during consultations with our licensed healthcare providers
Prescribing medications and monitoring your response to treatment
Coordinating your care with other healthcare providers, pharmacies, and healthcare facilities, including specialists you may see outside of Kind MD
Managing your medications and monitoring for potential drug interactions
Following up on your treatment progress through telehealth appointments or other communication methods

Payment

We use and disclose your health information as needed to obtain payment for the medical services we provide, including:

Billing you directly for services rendered
Processing your payment through credit card, debit card, bank transfer, or other payment methods
Verifying your insurance coverage and eligibility (if applicable)
Submitting claims to your insurance company or health plan (with your authorization)
Communicating with your health plan regarding coverage, authorization, or payment issues
Collecting payment for any amounts you owe

Healthcare Operations

We use your health information for business operations necessary to support treatment and payment activities, including:

Quality improvement activities, medical review, and competence assurance programs
Training healthcare providers, staff, and students
Evaluating the performance and qualifications of healthcare providers
Accreditation, licensing, and regulatory compliance
Business planning, development, and management

System administration and maintenance of our platforms and technology infrastructure

As Required by Law

We may disclose your health information when required or authorized by federal, state, or local law, including:

To public health authorities for disease surveillance, investigation, and control

Other Uses and Disclosures Without Authorization

We may also use and disclose your health information for the following purposes without your authorization:

To prevent or lessen a serious and imminent threat to public health or safety
To contact you regarding appointment reminders, test results, or other non-emergency health information (via phone, email, or text message)
To notify family members, emergency contacts, or healthcare agents of your location, condition, or death (unless you have requested we not do so)
To comply with state and local health regulations
As required for organ procurement organizations, tissue banks, and transplant services

Uses and Disclosures That Require Your Written Authorization

The following uses and disclosures of your health information require your written authorization:

Marketing communications or promotional activities (we do not use or sell your health information for marketing without your explicit consent)
Sale of your Protected Health Information to third parties (except as permitted by law)
Most disclosures of psychotherapy notes or behavioral health information
Disclosures to third parties not involved in your treatment, payment, or healthcare operations
Any use or disclosure beyond the purposes described in this notice

You may revoke your authorization at any time by providing written notice to our Privacy Officer. The revocation will take effect on the date we receive it, but will not affect uses or disclosures that occurred before the revocation.

Your Rights Regarding Your Protected Health Information

You have the following rights regarding your health information:

Right to Inspect and Copy

You have the right to inspect and obtain a copy of your health records maintained by Kind MD. You must submit your request in writing to our Privacy Officer. We will provide you with a copy of your records within 30 days. We may charge a reasonable fee for copying and mailing your records. In limited circumstances, we may deny access to your records, and we will provide you with an explanation if we do so.

Right to Amend

You have the right to request an amendment to your health records if you believe information is inaccurate or incomplete. Your request must be submitted in writing and include the specific information you wish to amend and the reason for the amendment. We will respond within 60 days. If we deny your request, we will provide you with a written explanation. You may request that your amendment be included with your health records even if we deny the amendment.

Right to an Accounting of Disclosures

You have the right to receive an accounting of disclosures of your health information. This accounting will include information about the date of the disclosure, the name and address of the person or organization to whom the information was disclosed, and the purpose of the disclosure. Accountings are available for disclosures made within the prior three years. You may request one accounting per calendar year at no cost. Additional accountings may result in a reasonable fee. We will provide the accounting within 30 days of your request.

Right to Request Restrictions

You have the right to request that we restrict our use and disclosure of your health information. While we will consider your request, we are not required to agree to all restrictions. Requests must be submitted in writing to our Privacy Officer. If we agree to your restriction, we will honor it unless the information is needed for emergency treatment. Please note that even if you request a restriction, we may still use and disclose your information as required by law.

Right to Request Confidential Communications

You have the right to request that we communicate with you about your health information by specific means or at specific locations. For example, you may request that we contact you only by email or at a specific phone number. We will accommodate reasonable requests. Your request must be submitted in writing to our Privacy Officer.

Right to a Copy of This Notice

You have the right to receive a copy of this Notice of Privacy Practices at any time. You can request a copy from our Privacy Officer, or you may access this notice on our website at kindmd.co.

Right to Breach Notification

You have the right to be notified of any unauthorized access to or disclosure of your unsecured health information. If Kind MD experiences a breach of your health information, we will notify you without unreasonable delay and in no case later than 60 days after discovery of the breach.

Changes to This Notice

Kind MD reserves the right to change this Notice of Privacy Practices at any time. We may make changes as required by law or at our discretion. If we make material changes to this notice, we will notify you of the changes and provide you with a copy of the revised notice. Changes will be effective on the date specified in the revised notice. Your continued use of Kind MD services after any changes constitute your acceptance of the revised notice. However, we will not use or disclose your health information in a way that is materially less protective of your privacy without your written consent.

Complaints and Questions

If you have concerns about your privacy or believe your health information privacy rights have been violated, you may file a complaint with Kind MD. To file a complaint, please contact our Privacy Officer in writing at the address or email provided below.
